Terms of Sale

This +Shop Terms of Sale explains how +Shop, by MarketNation Inc. (“+Shop”), manages your orders. By placing an order, you agree to these Terms of Sale, the +Shop Terms of Use, and related policies.


Definitions

  • “Company” or “MarketNation” or “MN” means MarketNation Inc., operator of +Shop, a distributed marketplace enabling people to Shop with Purpose™
  • “+Shop” means an online store operated by MN as a retailer, through which authorized Brand products are sold. MN manages storefront, inventory, payments, shipping, returns, taxes, and customer support. 
  • “Shopkeeper” means a user verified and approved by MN to promote and sell Products or facilitate Donations through the +Shop under these Terms. Shopkeepers represent a nonprofit or for profit fiduciary entity.

1. Submission of Your Order

  • To place an order, you must agree to these Terms of Sale, the +Shop Terms of Use, the +Shop Privacy Policy, the +Shop Return Policy, and the +Shop Shipping Policy.
  • It is your responsibility to comply with all applicable local, state, federal, and international laws regarding the purchase and use of products.
  • By placing an order, you represent and warrant that the products purchased will be used only in a lawful manner.


2. Acceptance of Your Order

  • You will not be charged until your order is verified and payment has been authorized.
  • +Shop reserves the right to decline or cancel any order at its sole discretion, even if you have received an order confirmation or your payment method has been charged.
  • Orders may be declined for reasons including, but not limited to:
    • Product unavailability
    • Pricing errors
    • Payment authorization issues
    • Suspected fraud or misuse
  • If an order is declined after payment has been processed, we will refund the full amount to your original payment method.
  • While order confirmations are typically sent by email, such confirmation does not constitute final acceptance of your order or a binding offer to sell.


3. Pricing Errors & Corrections

If a product is listed at an incorrect price or with incorrect information, +Shop reserves the right to cancel or refuse any orders placed for such a product, regardless of whether the order has been confirmed or payment has been processed. If payment has been made, a full refund will be issued to your original payment method.


4. Availability / Stock Changes Post-Order

Product availability is subject to change. If an item becomes unavailable after you place an order, +Shop may cancel or delay fulfillment and will notify you promptly. Any charges for unavailable products will be refunded.


5. Taxes

Applicable sales taxes will be collected at checkout where required by law. 

Title to products and risk of loss pass to you upon our delivery of the order to the carrier. 

For returns, +Shop does not take title until the item is received at our designated return center.


6. Order Cancellation

Where required by law, you may have the right to cancel your order within a specified period. To request cancellation, contact Customer Support as soon as possible. Cancellations are not guaranteed if the order has already been processed or shipped.


7. Product Descriptions

+Shop strives to ensure product descriptions and details are accurate. However, we do not warrant that descriptions, images, or other content are error-free, complete, or up to date. If a product received does not match its description, your sole remedy is to return it in unused condition in accordance with our Return Policy.


8. Fraud Prevention

+Shop reserves the right to require additional information or verification (such as proof of identity, billing, or shipping details) before processing an order. Orders suspected of fraud or unauthorized activity may be declined, canceled, or reported to the appropriate authorities.


9. Amendments and Notice of Changes

MarketNation (“+Shop”) may modify these Terms or related Program Policies at any time to reflect operational, legal, or regulatory updates. Any material change will be posted on the +Shop Legal page with the “Last Updated” date revised accordingly. Where required by law, +Shop will provide additional notice (such as email or in-account notification) before changes take effect. Continued use of +Shop Services or participation in the Shopkeeper Program after the effective date constitutes acceptance of the updated terms.


10. Force Majeure

Neither +Shop nor the customer will be liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including natural disasters, war, terrorism, labor disputes, embargoes, government actions, internet or utility failures, or other events of force majeure. In such cases, the affected party’s obligations are suspended for the duration of the event. +Shop will use commercially reasonable efforts to resume performance as soon as practicable.



Conflict of Terms

In the event of any inconsistency or conflict between this Policy and the Shopkeeper Program Agreement, the terms of the Shopkeeper Program Agreement shall govern and control. This Policy is incorporated into and subject to the Shopkeeper Program Agreement and the other Program Policies referenced therein.
